Terms of Service

These Terms of Service govern your use of Wandermi — the mobile app and the website wandermi.com. This is a single document covering both. Please read it: it explains what we offer, what you may and may not do, how we moderate content, and what your rights are.
1. About Wandermi
Wandermi is an AI-assisted travel app that helps travellers discover lesser-known places, avoid overcrowding and plan more sustainable trips. The “Service” means the Wandermi mobile application and the website wandermi.com.
The Service is operated by Wandermi SRL, a company incorporated under Italian law (“Wandermi”, “we”, “us”).

2. Acceptance of these Terms
These Terms of Service (“Terms”) form a binding agreement between you and Wandermi. By creating an account, downloading, installing or otherwise using the Service, you confirm that you have read and accept these Terms.
If you do not agree, do not use the Service.
These Terms apply together with our Privacy Policy, which explains how we process personal data. When we publish a materially updated version, we ask you to accept it again the next time you open the app; until you do, access to the Service may be suspended.
3. Eligibility and minimum age
You must be at least 14 years old to create an account and use Wandermi.
This threshold reflects Article 8 GDPR as implemented in Italy (D.lgs. 101/2018), which sets 14 as the age at which a minor may validly consent to information society services.
When you register you must declare your year of birth, and you must confirm that you meet the age requirement; we also check this on our servers. If we learn that an account belongs to someone under 14, we close it and delete the associated data.
If you are still a minor, we encourage you to read these Terms together with a parent or guardian.
You also confirm that you are legally able to enter into a binding agreement and that you are not barred from using the Service under any applicable law. If you use the Service on behalf of an organisation, you confirm that you are authorised to bind it to these Terms.
4. Your account and email verification
To use most features you need an account. You can register with an email address and a password, or through a supported third-party sign-in provider.
If you register with an email address, we send you a verification message: new email accounts must verify their address before using the Service. This protects the community against fake accounts and abuse.
You agree to:
• provide accurate, current and complete information, and keep it up to date;
• keep your credentials confidential and not share your account;
• be responsible for everything that happens under your account;
• write to support@wandermi.com immediately if you suspect unauthorised access.
You can delete your account at any time from the app (Profile → Settings → Delete account).
5. Public username (@handle)
Every account has a unique public username (a “@handle”). It is visible to other users on your profile and next to your content. For accounts created through a third-party sign-in provider, a username is assigned automatically and can then be changed.
Your username must not infringe third-party rights (including trademarks and other people’s names), impersonate anyone, or contain offensive or misleading terms. Certain terms are reserved and cannot be registered.
You can change your username in Settings, subject to anti-abuse limits. When you change it, your previous username becomes available to other users again. We may reclaim, reassign or remove a username that breaches these Terms.
6. The Service — what we offer
Wandermi currently offers:
• AI-assisted trip planning and personalised itineraries;
• crowd estimates that help you avoid overcrowded places at busy times;
• discovery of lesser-known destinations (“Hidden Gems”), including community nominations;
• saved trips, itinerary organisation and a travel diary with photos;
• social features: profiles, comments, chat and content sharing;
• an Impact Score reflecting more sustainable travel choices.
Wandermi is an information and planning tool. We are not a travel agency, a tour operator or a booking intermediary: we do not sell, arrange or guarantee transport, accommodation or any other travel service.
We may change, add, suspend or discontinue features. Where a change materially reduces the Service, we give you reasonable prior notice, unless we have to act immediately for legal or security reasons.
7. AI assistant
Wandermi includes a travel assistant based on generative artificial intelligence. The underlying model is provided by Google (Gemini). When you use the assistant, you are interacting with an AI system, not with a human being.
The assistant’s answers are generated automatically and are suggestions only. They can be wrong, incomplete or out of date — including opening hours, prices, availability, entry requirements and the actual condition of a place. Always verify anything that matters before relying on it. Wandermi is not responsible for the decisions you take on the basis of the assistant’s suggestions.
Use of the assistant is subject to a limit of up to 30 messages per day per user, applied to protect the quality and sustainability of a free service; a lower limit may apply to newly created accounts as an anti-abuse measure. These limits may change. They are an anti-abuse and cost-control measure, not a paywall, and cannot be lifted by payment.
You must not use the assistant to generate unlawful, harmful, hateful, sexually explicit or abusive content, to attempt to bypass its safeguards, or for purposes unrelated to travel planning.
If an AI answer is inappropriate, you can report it directly from the chat by long-pressing the message. AI answers are covered by the moderation and reporting process described below.

8. Crowd data and recommendations
Crowd levels, busy-time indications and recommendations shown in Wandermi are estimates, produced from historical patterns, public data sources and reports submitted by other users. They are provided for information only.
We do not guarantee that crowd data, forecasts, Hidden Gem information or any recommendation is accurate, complete or up to date, and we are not liable for decisions taken on the basis of them. Conditions on the ground may differ significantly from what the app shows.
When you submit a crowd report you must report honestly and in good faith. Deliberately false or manipulative reports are a breach of these Terms.
9. User content
“User Content” means anything you submit to the Service: itineraries, photos, diary entries, comments, replies, ratings, Hidden Gem nominations, crowd reports, chat messages and your profile information.
You keep ownership of your User Content. We do not claim it.
By submitting User Content, you confirm that you own it or have all the rights needed to submit it, and that it does not break the law or infringe anyone else’s rights (including copyright, trademarks, privacy and image rights). If your content shows other identifiable people, you must have their agreement where the law requires it.
You grant Wandermi a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, adapt for technical purposes (such as resizing or format conversion) and display your User Content, for the sole purpose of operating and providing the Service, and — in anonymised and aggregated form, from which you cannot be identified — to improve the Service and to produce public-interest statistics. This licence ends when you delete the content or your account, except for copies lawfully saved by other users, for anonymised aggregates that no longer identify you, and where we must keep a copy to comply with a legal obligation.
Public User Content (for example ratings, Hidden Gem nominations, public comments and anything shared through a public link) can be seen by other people. Think about what you share before you share it.
We may remove User Content that breaches these Terms, the law or our community standards, in accordance with the moderation process described below.
10. Acceptable use
You may use the Service only for lawful purposes. You must not:
• break any applicable law (Italian, EU, or the law of your country of residence);
• upload or transmit content that is illegal, hateful, discriminatory, violent, sexually explicit, harassing, defamatory or deceptive, or that depicts minors inappropriately;
• harass, threaten, stalk or bully anyone, or incite hatred or violence;
• impersonate any person or entity, or falsely claim an affiliation;
• post spam, unsolicited advertising or manipulated content, including fake crowd reports and fake reviews;
• collect or harvest other users’ personal data, or attempt to determine the precise location of another user;
• attempt to gain unauthorised access to the Service, our systems or other users’ accounts, or interfere with their security or integrity;
• use bots, scrapers or crawlers to extract data from the Service without our written permission, or circumvent technical limits, quotas or device-integrity checks;
• reverse engineer or decompile the Service, except to the extent this cannot lawfully be prohibited;
• circumvent or undermine our content moderation measures, or evade a suspension;
• use the Service in a way that could damage, disable or overburden it.
You are also expected to report illegal content you come across on the platform, using the tools described below.
11. Sharing itineraries via public link
You can generate a public link to share an itinerary. Anyone who has the link can view the shared content (itinerary, stops and any photos included), even without a Wandermi account and outside the app. Consider carefully what you share, and with whom.
You can deactivate the link at any time from the sharing settings in the app. Deactivation makes the content immediately inaccessible through that link, but has no effect on copies already saved by others or on content already reproduced elsewhere.
You are responsible for the links you generate and for how they are distributed.
12. Content moderation — zero tolerance (DSA Art. 14)
Wandermi applies a zero-tolerance policy to illegal content and to content that is hateful, violent, sexually explicit, harassing, or that depicts minors inappropriately. This applies to all User Content — photos, comments, replies, chat messages, crowd reports — and to answers produced by the AI assistant.
How moderation works:
• You can report any content from within the app (see the next section) or by writing to legal@wandermi.com.
• Reports are examined by our designated moderator, who aims to review them within 48 hours of receipt.
• Content that breaches these Terms or the law is removed. In serious or repeated cases the account responsible may be suspended or closed and, where the law requires it, we notify the competent authorities.
• Content that receives several independent reports may be automatically hidden from public view pending human review. This is a precautionary measure, not a final decision.
• You can block another user at any time to stop further contact and interaction.
Where Regulation (EU) 2022/2065 (Digital Services Act) requires it, if we remove your content or restrict your account we send you a statement of reasons explaining the decision and how to challenge it.
Wandermi is a micro-enterprise and is therefore exempt from several of the additional obligations the DSA places on larger platforms. The obligations described in these Terms are those that apply to us.

13. Reporting mechanism (DSA Art. 16)
We provide accessible tools to report content that may breach these Terms or the law:
• Comments and replies: long-press the comment and select “Report”.
• Chat messages: long-press the message and select “Report”.
• Photos and other community content: use the report action in the content menu.
• AI answers: long-press the assistant’s message and select “Report”.
• Users: you can block a user from the chat or profile settings.
When you report, you can choose a category (for example spam, harassment, inappropriate content, illegal content, misinformation or threats) and add an explanation.
For urgent matters — illegal content, imminent threats, anything requiring immediate attention — write to legal@wandermi.com. Where possible include a link or the details needed to locate the content, an explanation of why it is unlawful or in breach, and your contact details.
We acknowledge receipt of reports sent by email and inform the reporter of the outcome. Reports made in bad faith, or that are manifestly unfounded and repeated, may lead to restrictions on your ability to submit further reports.
14. Transparency (DSA Art. 15)
As a micro-enterprise, Wandermi is exempt from the DSA obligation to publish full transparency reports (Art. 15(2)). We nevertheless apply the following transparency practices:
• we inform you when content you reported has been reviewed and what action was taken;
• we inform you when your content is removed or your account is restricted, giving the reasons and telling you how to appeal;
• we indicate where a moderation decision was taken with the help of automated tools;
• we intend to publish a periodic summary of our moderation activity — the number and type of reports received and the action taken — in a form proportionate to our size, and we will publish full transparency reports if and when we become legally required to do so.
15. Appeals
If we remove your content, restrict its visibility, or suspend or close your account, you can appeal.
Write to legal@wandermi.com within 30 days of the decision. Include your username, what was removed or restricted, and why you believe the decision was wrong. Appeals are handled at legal@wandermi.com; that is the only address for this purpose.
Appeals are reviewed by a human being — never by automated means alone — and we aim to answer within 14 days. If we find that the decision was wrong, we reinstate the content or the account without undue delay.
Appealing to us does not affect your right to bring the dispute before a court or, where available, before an out-of-court dispute settlement body certified under Article 21 of the Digital Services Act.
16. Intellectual property
All intellectual property in the Service — the Wandermi name and logo, the design of the app and the website, the software, the databases, the models and configurations we develop, and our original content — belongs to Wandermi or its licensors. These Terms grant you no rights over it beyond what is necessary to use the Service as intended.
You may not copy, modify, distribute, sell, licence or create derivative works from any part of the Service without our prior written consent.
If you believe that content on Wandermi infringes your intellectual property rights, write to legal@wandermi.com with the relevant details.
17. Third-party services and links
The Service integrates third-party services (including Google and Mapbox mapping services, Google’s Gemini AI model, and infrastructure and notification providers) and may contain links to external websites. Those third parties have their own terms and privacy policies, which we encourage you to read.
Wandermi is not responsible for the content, accuracy, availability or practices of third-party services and websites.
If the Service includes affiliate links (for example eSIM providers or travel insurance), we will say so, and we may receive a commission if you make a purchase. This does not affect the recommendations we give.
18. Paid features
Wandermi is currently free of charge. There are no active subscriptions and no in-app purchases: no payment is requested and no payment data is processed.
Some features are shown in the app as “coming soon” (for example printed photo albums). They are not available and cannot be purchased today.
If we introduce paid features in the future, we will publish clear prices and conditions before any charge, we will ask for your express consent to each purchase and — where necessary — we will update these Terms. Consumer rights, including the right of withdrawal where applicable, will be respected.
The daily limits on the AI assistant are an anti-abuse and cost-control measure; they are not a paywall and cannot be removed by payment.
19. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied.
In particular, we do not warrant that:
• crowd estimates, Hidden Gem information, AI-generated itineraries or any other content are accurate, complete or up to date;
• the Service will be uninterrupted, timely, secure or free of errors or viruses;
• the recommendations are suitable for your particular circumstances, your health, your safety or your legal status at a given destination.
Travel involves inherent risks. You alone are responsible for checking travel requirements (visas, entry restrictions, health and safety conditions, local law) and for your own safety while travelling.
Nothing in this section limits rights that consumers have under mandatory law.
20. Limitation of liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for wilful misconduct or gross negligence, or for any other liability that cannot be excluded or limited under Italian or EU law — including the mandatory protections of the Italian Consumer Code (D.lgs. 206/2005).
Subject to the above, and to the fullest extent permitted by law:
• we are not liable for indirect or consequential loss, loss of profit, revenue, data or goodwill, or for the cost of substitute services;
• we are not liable for damage arising from your reliance on AI-generated suggestions, crowd estimates or Hidden Gem information;
• we are not liable for User Content published by other users, nor for the conduct of other users or third parties;
• we are not liable for travel disruption, cancellations, denied entry or any other consequence of a travel decision you take.
Because the Service is currently provided free of charge, our total aggregate liability to you for all claims arising out of or in connection with these Terms shall not exceed the greater of (a) the amount you have actually paid us in the 12 months preceding the event giving rise to the claim — which today is zero, since the Service is free — and (b) EUR 50.
This cap does not apply to liability that cannot be limited under mandatory law.
21. Indemnification
If you use the Service in the course of a trade, business or profession (that is, not as a consumer), you agree to defend, indemnify and hold harmless Wandermi and its directors, employees and agents against any claim, damage, loss or expense (including reasonable legal fees) arising from:
• your use of the Service in breach of these Terms or of the law;
• your User Content;
• your infringement of third-party rights.
If you are a consumer, this section does not apply to you: your liability towards us is governed by the ordinary rules of law, and you answer only for damage actually caused through your own fault.
22. Suspension and termination of the account
You can stop using the Service at any time and delete your account from the app (Profile → Settings → Delete account). Deletion removes your account and the associated content from our systems, as described in the Privacy Policy.
We may suspend or close your account:
• with immediate effect, if you seriously or repeatedly breach these Terms, if you publish illegal content, or if this is necessary to protect the Service, other users or third parties;
• with reasonable prior notice, in any other case, including if we discontinue the Service.
Where we suspend or close your account for a breach, we tell you why and you may appeal (see section 15).
On termination, your right to use the Service ends. Provisions which by their nature must survive — including intellectual property, disclaimers, limitation of liability, governing law and final provisions — remain in force.
23. Changes to these Terms
We may update these Terms, for example to reflect new features, new legal requirements, or changes in how the Service works.
When we make material changes, we update the “last updated” date and notify you in the app and, where appropriate, by email. Material changes take effect no earlier than 30 days after notice, unless a change must apply immediately for legal or security reasons.
When a new version is published, we ask you to accept it the next time you open the app. If you do not accept it, you cannot continue to use the Service and you may close your account. Anything you have lawfully done under the previous version is unaffected.
24. Governing law and jurisdiction
These Terms are governed by Italian law.
If you are a consumer resident in the European Union, this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of your country of habitual residence. Any dispute may be brought before the courts of the place where you are resident or domiciled: that forum is mandatory and cannot be derogated from by these Terms, and we may bring proceedings against you only before those courts.
If you are not a consumer (that is, you use the Service for purposes relating to your trade, business or profession), the courts of the place where Wandermi has its registered office shall have exclusive jurisdiction.
Before starting formal proceedings, we ask you to contact us at legal@wandermi.com: we try to resolve disputes promptly and amicably. Consumers may also use the out-of-court dispute resolution bodies available under Italian law (mediation and conciliation bodies).
25. Final provisions
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions continue in full force and effect, and the invalid provision is replaced by a valid one that comes as close as possible to its purpose.
Our failure to enforce a provision is not a waiver of it.
You may not assign these Terms without our consent. We may assign them to a company that takes over the Service, provided your rights are not reduced; we will notify you in advance.
These Terms, together with the Privacy Policy and the Cookie Policy, constitute the entire agreement between you and Wandermi regarding the Service and replace any previous version.
These Terms are published in several languages. The Italian and English versions are the reference versions; in the event of discrepancy the Italian version prevails, without prejudice to any mandatory rule protecting consumers in their own language.
