Terms of Service

Wandermi is an AI-powered travel application designed to help travellers discover hidden destinations, avoid overtourism, and plan sustainable trips. The Service is operated by Wandermi (currently undergoing incorporation as a Società a Responsabilità Limitata – SRL – Startup Innovativa under Italian law, based in Milan, Italy). You must be at least 18 years old to create an account and use the Service. By using Wandermi, you confirm that you meet this age requirement and that you are legally capable of entering into binding agreements under applicable law. If you are accessing the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

To access certain features of the Service, you must create an account. You agree to: • Provide accurate, current, and complete information during registration • Keep your account credentials secure and not share them with third parties • Notify us immediately at support@wandermi.com if you suspect unauthorised access to your account • Be responsible for all activity that occurs under your account We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period, with prior notice where reasonably practicable.

Wandermi provides: • AI-powered travel planning and personalised itinerary generation • Real-time crowd intelligence to help you avoid overcrowded destinations • Hidden Gem discovery — community-curated lesser-known places • Saved itineraries, trip organisation, and travel companion features • Impact Score tracking to measure and reward sustainable travel choices The Service is provided in a free tier. Certain advanced features may require an in-app upgrade in a future release. Any pricing changes will be communicated with at least 30 days' advance notice. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice to users where possible.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not: • Violate any applicable law or regulation (Italian, EU, or the laws of your country of residence) • Upload, post, or transmit content that is illegal, harmful, defamatory, obscene, or infringes third-party rights • Impersonate any person or entity, or falsely claim affiliation with any organisation • Attempt to gain unauthorised access to any part of the Service, our systems, or other users' accounts • Use automated tools (bots, scrapers, crawlers) to extract data from the Service without our written permission • Interfere with or disrupt the integrity or performance of the Service • Use the Service to send unsolicited communications (spam) • Collect or harvest other users' personal information without their consent • Engage in any activity that could damage Wandermi's reputation or business interests We reserve the right to remove content, restrict access, or terminate accounts that violate these rules.

The Service allows you to submit content including travel itineraries, destination ratings, Hidden Gem nominations, photos, and comments ("User Content"). By submitting User Content, you: • Confirm that you own the content or have the right to submit it • Grant Wandermi a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute your User Content within the Service and, in anonymised/aggregated form, for service improvement and B2G data initiatives • Understand that public User Content (ratings, Hidden Gem nominations) may be visible to other users We do not claim ownership of your User Content. You remain the owner. We reserve the right to remove User Content that violates these Terms, applicable law, or our community standards, without prior notice.

All intellectual property in the Service — including the Wandermi name, logo, app design, AI models, software, and original content — belongs to Wandermi or its licensors. Nothing in these Terms grants you any right to use our intellectual property other than as necessary to use the Service as intended. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written consent.

The Service integrates with third-party services (including Google Maps, Mapbox, and accommodation or activity booking providers) and may contain links to external websites. These third parties have their own terms and privacy policies, which we encourage you to review. Wandermi is not responsible for the content, accuracy, or practices of any third-party services or websites. Where the Service includes affiliate links (e.g., eSIM providers, travel insurance), we may receive a commission if you make a purchase. This does not affect our editorial independence or the recommendations we provide.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW. In particular, Wandermi does not warrant that: • Crowd intelligence data, Hidden Gem information, or AI-generated itineraries are accurate, complete, or up to date • The Service will be uninterrupted, error-free, or free of viruses • Travel recommendations are appropriate for your specific circumstances, health conditions, or legal status in a given destination Travel involves inherent risks. You are solely responsible for verifying travel requirements (visas, entry restrictions, health and safety conditions) and for your own safety during travel.

To the maximum extent permitted by applicable law (including the Italian Consumer Code, D.Lgs. 206/2005, for consumer users), Wandermi shall not be liable for: • Any indirect, incidental, special, consequential, or punitive damages • Loss of profits, revenue, data, or goodwill • Costs of substitute goods or services • Any damages resulting from reliance on AI-generated travel recommendations, crowd data, or Hidden Gem information arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising under these Terms shall not exceed the greater of (a) the amount you paid to Wandermi in the 12 months prior to the claim or (b) €50. Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under applicable Italian or EU law.

You agree to defend, indemnify, and hold harmless Wandermi and its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from: • Your use of the Service in violation of these Terms • Your User Content • Your violation of any third-party rights

You may stop using the Service and delete your account at any time via the app settings (Profile → Delete Account). We may suspend or terminate your access to the Service with immediate effect if you materially breach these Terms, or with 30 days' notice for any other reason. Upon termination, your licence to use the Service ends. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) will remain in effect.

These Terms are governed by and construed in accordance with Italian law, without regard to its conflict of law provisions. For consumer users (as defined by Italian law), any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of your place of residence in Italy, or of the courts of Milan if you are not resident in Italy. For business users, disputes shall be subject to the exclusive jurisdiction of the courts of Milan, Italy. We encourage you to contact us at legal@wandermi.com before initiating formal proceedings — we aim to resolve disputes amicably and promptly.

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and notify you via email or in-app notification at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service before the effective date.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Wandermi regarding the Service and supersede all prior agreements.
